Acceptance of Terms

By accessing or using viralvideoai.app ("the service"), you agree to these Terms of Service. If you do not agree, do not use the service.

The service is operated by ViralVideoAI. Our Privacy Policy (/privacy-policy) is incorporated into these Terms by reference.

Who may use the service

You must be at least 13 years old to use the service, or the minimum age set by law in your country if that is higher (16 in parts of the EU/UK). You must be old enough to form a binding contract and not barred from receiving the service under the law of any country whose law applies to you.

If you use the service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

Description of the service

The service turns photos you upload into AI-generated short videos based on trend templates. It is a one-tap generator: you pick a template, upload the photo(s) the template asks for, pay the credits for the template, and the service returns a 9:16 video file.

Credits are the service's internal unit. You buy them in one-time packs or receive them with a subscription plan. The current catalogue is on /pricing. We may change the catalogue, prices and credit costs, and will apply the change prospectively.

Your account

You are responsible for keeping your account credentials secret, for every action under your account, and for notifying us at support@viralvideoai.app of any unauthorised use.

Acceptable use

You agree not to:

• Break any applicable law.
• Attempt to access the service or any user's account without authorisation.
• Interfere with the service, probe for vulnerabilities, scrape at a rate that degrades it, or submit malware.
• Resell access to the service, redistribute the videos commercially where the template is marked non-commercial, or build a competing service on top of our API.
• Evade credit charges, refund mechanisms, rate limits, abuse detection or geographic restrictions.
• Use the service to send spam, phishing, harassment or defamatory content.

Content you upload

You keep all intellectual-property rights in the photos you upload. You grant us a limited, non-exclusive, royalty-free licence to store the photos, derive a face embedding from them where the template requires one, pass them to the AI model that renders your video, and keep the rendered video available in your library — all for the limited retention periods set out in the Privacy Policy.

We will not use your uploaded photos, face embeddings or generated videos to train any AI model.

Rights of third parties and model release

You confirm, every time you upload a photo:

1. The photo is of you, your pet or an object you own, a person who has given you their express, informed consent to be used in an AI-generated video on this service, or a person otherwise in the public domain for this specific purpose under the law that applies to you.
2. You will not upload a photo of a minor unless you are their parent or legal guardian and consent on their behalf for this specific use.
3. You will not use the service to impersonate a real person, to create content that could reasonably be mistaken for genuine footage of someone saying or doing something they did not say or do, or to create content for the purpose of defrauding, harassing, defaming or sexually objectifying any real person.
4. You will not upload the photograph of a celebrity, public figure, athlete, politician, deceased personality or other person whose face or likeness is protected by right-of-publicity, name-image-likeness or similar laws, unless you have their express written permission or an exemption under the law that applies to you. Some templates on the service reference celebrity trends; those references are for stylistic parody of a format, not an invitation to upload a photograph of the celebrity.
5. The photo is not CSAM (child sexual abuse material), is not non-consensual intimate imagery, and does not depict identifiable third-party trademarks or copyrighted works in a way that infringes the owner's rights.

You are responsible for the lawfulness of every photo you upload. If a photo breaches this clause, we may delete it, refuse to render the video, revoke the credits for it, suspend or close your account, and report the matter to law enforcement.

Content moderation

The service includes automated and human review for the clauses above and for CSAM, violent extremism and other unlawful content. We may block an input, cancel a render in progress, or remove a rendered video at any time if it violates these Terms or any law. We will refund the credits for a render we cancel for a non-abuse reason; we do not refund credits for a render cancelled for the abuse reasons in this section.

Payment, credits and refunds

Prices are in US dollars unless the checkout session shows a different currency. Taxes are added at checkout where we are required to collect them.

One-time packs. You pay upfront. Credits from a pack never expire and remain on your account until you spend them or close the account.

Subscription plans. Billed in advance for the stated billing period (weekly or monthly). Plan credits are reset at the start of each billing period and do not roll over. You can cancel at any time in Profile; cancellation takes effect at the end of the current billing period.

Introductory offers. Any introductory price (for example, a reduced first week or first month) applies once per customer, is applied through a payment-processor coupon at checkout, and the regular price takes effect from the next billing cycle. The regular price is shown next to the introductory price on /pricing.

Failed renders. If a render fails on our end, the credits for that render are returned to your balance automatically. You never pay for a broken job.

Refunds. Credits spent on a successful render are not refundable. For a payment made in the last 14 days where you have not yet spent the credits, write to support@viralvideoai.app and we will refund the unused amount in full. For an unused subscription period, we will refund pro-rata to the end of the period. We may refuse a refund for an account with signs of abuse (chargeback fraud, resale, farming).

Chargebacks. A chargeback by your bank or card network before we have had a chance to issue a refund will suspend your account until the dispute is resolved.

Our content and intellectual property

The templates, the service's software, the UI, the brand, the trade marks and the sample videos on the site are owned by us or our licensors and are protected by copyright, trade mark and other intellectual property laws. These Terms grant you a limited, non-transferable right to use the service — nothing else.

The videos the service generates for you from your own photos are yours to download, post and share on social platforms, subject to the Acceptable Use clause above. Where a template is marked non-commercial, you may not use its output for paid promotion, paid advertising or sale.

DMCA and takedown

ViralVideoAI respects intellectual property rights and the rights of real people whose faces or likenesses appear in content on the service. If you believe content on the service infringes your copyright or your right of publicity:

1. Send a notice to takedown@viralvideoai.app. We also accept DMCA notices by post to the designated agent on file with the US Copyright Office at copyright.gov (we will update this clause with the postal address once registration is complete; until then, the email address is the valid route).
2. Include: identification of the work or likeness, the URL or job identifier of the content you want removed, your contact details, a statement of good-faith belief that the use is not authorised, and a statement under penalty of perjury that the information is accurate and that you are the rights holder or authorised to act for them.
3. We remove compliant content within 72 hours of a valid notice.

If content of yours is removed and you believe this is a mistake, you may submit a counter-notice to the same address with the information required by 17 U.S.C. §512(g).

Termination

You may close your account at any time in Profile. We may suspend or terminate your access for a material breach of these Terms, for repeated takedowns, for a chargeback dispute, or where we are required to do so by law. On termination, we delete your data on the schedule in the Privacy Policy; credits on your account are forfeited.

Disclaimers

The service is provided "as is" and "as available". AI-generated videos may contain errors, artefacts or results that are not what you asked for; this is a property of the current generation of AI video models, not a defect of the service. We disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, in no event will ViralVideoAI be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or lost goodwill, arising out of or related to your use of the service. Our total liability for any claim relating to the service is capped at the amount you have paid us in the twelve months preceding the event giving rise to the claim, or USD 100, whichever is greater.

Indemnity

You agree to defend, indemnify and hold harmless ViralVideoAI from any third-party claim arising out of content you uploaded, your breach of these Terms, or your misuse of the service, including a claim brought by someone whose photograph you uploaded without authority or a claim brought over a video you generated.

Governing law and disputes

These Terms are governed by the law of the State of Delaware, USA, without regard to conflicts-of-law rules. For any dispute, the state and federal courts located in Wilmington, Delaware have exclusive jurisdiction, except that either party may seek emergency injunctive relief in any court of competent jurisdiction. If you live in the European Economic Area, the United Kingdom or Switzerland, the mandatory consumer protections of your country of habitual residence apply in addition to this clause.

Changes to these Terms

We may change these Terms. We will update the "updated_at" date at the top and, for material changes, notify you by email or through the service at least 14 days before the change takes effect, except for changes required by law or security.
